What type healthcare facilities are required to conduct criminal history record checks (CHRC)?

Hospitals, Home Health Agencies, Hospices, Long Term Care Facilities, Personal Care Homes (Assisted/Residential Living), Nursing Schools.

Why must a facility conduct criminal history record checks?

During the regular 2003 MS Legislative Session, the Legislature passed House Bill 1077. This statute required MSDH to develop regulations to implement and enforce the CHRC process.
On July 09, 2003, the MSDH approved final adoption of regulations pertinent to CHRC. These regulations go into effect for healthcare facilities 30 days after final adoption.

Per the statute, what is the definition of “employee”?

The term employee means “any individual employed by a licensed entity. The term employee also includes any individual who by contract provides to the patients, residents or clients being served by the licensed entity direct, hands-on medical patient care in a patient’s, resident’s or client’s room or in treatment or recovery rooms.”

Who must be fingerprinted per statute/regulations?

Every new employee of the licensed entity who provides direct patient care or services employed on or after July 01, 2003; and every employee of the licensed facility employed before July 01, 2003, who has a documented disciplinary action by his or her present employer.

When may I submit fingerprints to the MSDH for processing?

Fingerprints may be submitted at any time.

Where do I get the Mississippi Applicant Fingerprint Cards?

Facilities must get Applicant Fingerprint Cards from MSDH. Each card has a unique identifier (ORI number) that allows its acceptance into the national database. MSDH will mail all healthcare providers a packet of cards initially. Facilities should contact MSDH to request additional cards, when needed.
