Agency with the authority to run the background check process:

Hawaii Criminal Justice Data Center (HCJDC), Department of the Attorney General

State statute (Pub. L. 92-544) or authority exists to authorize submission of CJIS background checks to the FBI database for vendors and private sector contractors who have direct access to criminal justice information/systems.

No state statute. For criminal justice agency vendors, fingerprint-based criminal history record checks are submitted under the FBI CJIS Security Policy. Fingerprint-based criminal history record checks are not conducted on civil/non-criminal justice agencies who have access to CJI or state CJI systems since there is no authorizing statute.

Authorized channelers?

Channelers are vendors that have direct access to the FBI CJIS WAN. In their channeling role, these vendors do not collect or submit background checks to the HCJDC. Criminal justice agencies are able contract with a private fingerprinting vendor to collect and submit fingerprints to the HCJDC for criminal history record checks for their employees and vendors.

Required documents to initiate a background check:

Consent/acknowledgment forms, valid government-issued photo ID, fingerprints.

Preferred method of submission of required information.

Any method of submission is acceptable.

Are fingerprint cards from outside the state accepted?

Yes. The HCJDC accepts hard-copy cards for processing that are delivered to the HCJDC in a sealed envelope stamped by the fingerprinting official, with a statement from the fingerprinting official that the applicant's identity has been verified via government-issued photo-ID. Also, out-of-state applicants may use the service of a fingerprinting vendor, if the criminal justice agency has contracted with one, for the electronic submission of fingerprints.

Process for non-criminal justice checks:

The criminal justice agency retrieves the results of the criminal history record check through the State's online system and makes the initial suitability determinations. All checks resulting in a match to a criminal record are forwarded to the State's CJIS System Officer for final determination and approval or disapproval for access to criminal justice information systems. When fingerprints are required, one set of prints is needed. A state card is not required in addition to the FD258. Fingerprints may be submitted on cards or electronically.

Time required for obtaining results of a non-criminal-justice background check.

Results will be available to the authorized agency within one to three business days.

Fees involved:

For criminal justice agency vendors being processed per the FBI CJIS Security Policy, there is no fee for taking fingerprints if taken by State or criminal justice agency. A private fingerprinting vendor may charge fees. There are no fees for running checks against state repository databases or for running checks against FBI databases.
